In the case of the pollution risk, what gives you the right to throw the lever? We have democratic governance to decide this.

Hm...this is an interesting expansion. What gives a company the right to make this or any decision? Companies aren't democratically governed, but there are regulators and governments monitoring companies (the rollback of the Chevron Doctrine aside).

Today, I suppose I'd fall back on the business judgement rule, backed by research and evidence.
